Terms of Service

These terms govern your use of OmniView ("the Service"), operated via holossystems.com. By creating an account or using the Service, you agree to these terms.

1. The Service

OmniView is a media synchronization platform that allows you to collect, synchronize, and display multi-camera footage and photos from live events. The Service includes:

  • Video and photo upload and storage
  • Automatic audio/visual synchronization
  • An embeddable multi-camera viewer
  • Event management dashboard
  • API access for integration

2. Accounts

  • You must provide accurate information when creating an account.
  • You are responsible for keeping your password secure.
  • You must be at least 16 years old to create an account.
  • One person or organization may not maintain more than one free account.

3. Plans and payments

Free plan

The Free plan includes 1 event, 5 videos, 1 GB storage, and 30 days of hosting. OmniView branding is displayed on the viewer.

Paid plans

  • Pro (€499/event) — 100 videos, 50 GB storage, 12 months hosting
  • Business (€999/event) — 500 videos, 250 GB storage, 24 months hosting, white-label
  • Enterprise — custom pricing, contact us

Payments are one-time, per event. All prices are in euros and exclude VAT. Payments are processed securely via Stripe.

Refunds

We offer a full refund within 14 days of purchase if no media files have been uploaded to the event. After media has been uploaded and synchronized, refunds are handled on a case-by-case basis. Contact us at support@holossystems.com.

Hosting extensions

You may extend your event's hosting period before it expires. If you do not extend, the event will expire automatically and data will be deleted as described in section 5. We will send a reminder email before expiration, but it is ultimately your responsibility to extend or download your content in time.

Payment disputes

If you initiate a chargeback or payment dispute, we reserve the right to immediately suspend your account and all associated events until the dispute is resolved. Fraudulent chargebacks may result in permanent account termination.

4. Content and ownership

Your content

You retain full ownership of all videos, photos, and other content you upload. By uploading content to OmniView, you grant Holos Systems a worldwide, non-exclusive, royalty-free license to:

  • Store, process, synchronize, transcode, and display your content as part of the Service
  • Access and review all uploaded content for the purposes of content moderation, quality assurance, technical support, service improvement, and compliance with legal obligations
  • Create and retain anonymized derivatives (such as audio fingerprints, sync metadata, and camera intrinsics) for research and service improvement purposes, even after the original content is deleted
  • Use anonymized, aggregated data derived from your content to develop new features and improve synchronization technology

This license continues for as long as your content is stored on our platform, and — for anonymized derivatives — indefinitely. You may request deletion of your original content at any time, subject to the data retention terms in section 5.

Platform access to content

Holos Systems personnel may access uploaded content when strictly necessary for platform operations, including but not limited to: sync quality verification, abuse prevention, technical debugging, customer support, content moderation, and compliance with legal obligations. Access is limited to authorized personnel and performed in accordance with our Privacy Policy. By using the Service, you acknowledge and consent to this access.

Your responsibilities as event organizer

When event attendees upload videos or photos via your event's upload link, you (the event organizer) are the data controller for that content and OmniView acts only as your processor. You are solely responsible for, and you warrant that:

  • Lawful basis. You have a valid legal basis under the GDPR for the capture, upload, processing, and public display of that content, including content depicting attendees and any third parties who appear in the footage but did not upload it (bystanders).
  • Portrait rights. You have obtained, or have a valid legal basis in lieu of, the permissions required (including under Article 21 of the Dutch Copyright Act) to publicly display recognizable individuals.
  • Notice to attendees. You inform attendees, by means appropriate to your event, that filming takes place and that footage may be uploaded to and publicly displayed via OmniView. For ticketed events this is done primarily through your ticket terms, published house rules, event app, or on-screen notices; for open or public events where no ticket or entry condition binds attendees, you provide more visible notice such as signage or announcements.
  • Your own terms. You incorporate appropriate notice and, where required, consent into your own ticket terms, house rules, and event conditions.
  • Point of upload. You provide attendees with a link to these Terms and our Privacy Policy at the point of upload.
  • Minors. You are responsible for handling footage of minors lawfully, including obtaining parental or guardian consent where required, and you will not use the Service for events primarily directed at children without appropriate additional measures.
  • Requests. You promptly handle access, objection, and erasure requests from attendees and from third parties who appear in the footage, and you forward to us any request concerning content still hosted on OmniView so we can act on it.
  • Compliance. You comply with the GDPR, the Dutch UAVG, and all other applicable privacy and image-rights laws regarding crowd-filmed footage and photography.

Downstream use and republication

Any content you download from OmniView and then publish, share, broadcast, or otherwise distribute outside the OmniView platform — including on YouTube, social media, aftermovies, or any third-party service — is solely your responsibility as the publisher and controller of that copy. OmniView has no control over, involvement in, or responsibility for such republications.

You alone are responsible for handling any objection, removal request, edit, or portrait-rights or privacy claim relating to content you have republished off-platform. OmniView's removal and data-deletion tools apply only to content hosted on OmniView and cannot affect copies you have published elsewhere. Where an individual's objection to a republication is valid and not overridden by a lawful basis, you are responsible for stopping the use — by removing or adequately anonymizing the material — and the fact that editing may be impractical does not relieve you of that responsibility.

Indemnity

You will indemnify, defend, and hold harmless Holos Systems and its personnel against any and all claims, demands, proceedings, damages, fines, and costs (including reasonable legal fees) arising out of or relating to: (a) content uploaded by you or by attendees at your events; (b) your breach of any warranty or obligation in these Terms, including "Your responsibilities as event organizer" and "Downstream use and republication"; (c) any portrait-rights, privacy, defamation, or intellectual-property claim by any individual appearing in content associated with your events; and (d) any republication or distribution by you of content outside the OmniView platform.

Acceptable use

You agree to use the Service only for lawful purposes related to event video management. You may not:

  • Upload content that violates any law or regulation
  • Upload content that infringes on intellectual property rights
  • Upload explicit, violent, hateful, or otherwise objectionable material
  • Upload malware, malicious code, or files designed to disrupt the Service
  • Use the Service to build a competing product or to reverse-engineer our synchronization technology
  • Share API keys, upload links, or dashboard access with unauthorized parties
  • Attempt to circumvent storage limits, rate limits, or other plan restrictions
  • Resell access to the Service without a written reseller agreement

We reserve the right to remove content and suspend or terminate accounts that violate these terms, without notice or refund.

5. Data hosting and expiration

Media files (videos and photos) are hosted for the duration specified by your plan. After expiration:

  • All media files and personally identifiable data are permanently deleted
  • The viewer and embed links stop working
  • This process is automatic and irreversible

It is your responsibility to download any content you want to keep before your hosting period expires.

Anonymized data retention

After deletion of an event, we may retain anonymized and aggregated technical data derived from the synchronization process — such as audio fingerprint statistics, sync accuracy metrics, and platform usage patterns. This data cannot be linked back to any individual, video, or event and is used solely to improve the quality and performance of our sync engine.

6. API usage

API access is provided for integration purposes. You agree to:

  • Keep your API keys confidential
  • Not exceed reasonable rate limits
  • Not use the API to build a competing service

7. Availability and service levels

We aim to keep the Service available 24/7 but do not guarantee uninterrupted access. Specifically:

  • We do not guarantee any specific uptime percentage
  • We may perform maintenance, updates, or migrations at any time
  • Video synchronization is performed on a best-effort basis — sync accuracy depends on audio/visual quality and is not guaranteed
  • We are not liable for any losses caused by temporary unavailability, failed synchronization, or reduced sync quality

For Enterprise clients with specific uptime requirements, custom SLAs may be agreed upon in a separate written agreement.

8. Limitation of liability

The Service is provided "as is" and "as available". To the maximum extent permitted by applicable law:

  • We make no warranties, express or implied, regarding the Service, including warranties of merchantability, fitness for a particular purpose, or non-infringement
  • We are not liable for lost data, lost revenue, loss of business, or any indirect, incidental, special, or consequential damages
  • Our total aggregate liability for any claim arising from or related to the Service is limited to the amount you paid to OmniView in the 12 months preceding the claim
  • We are not responsible for the content uploaded by third parties (event attendees)
  • We are not responsible for any decisions made based on synchronized video or photo output

9. Termination

  • You can delete your account at any time by contacting us.
  • We may suspend or terminate accounts that violate these terms.
  • Upon termination, your data will be deleted in accordance with our Privacy Policy.

10. Changes to these terms

We may update these terms from time to time. If we make significant changes, we will notify you via email or a notice on the website. Continued use of the Service after changes constitutes acceptance.

11. Governing law and jurisdiction

These terms are governed by the laws of the Netherlands. Any disputes arising from or relating to these terms or the Service shall be submitted exclusively to the competent court in Groningen, the Netherlands.
